These Terms of Use ("Terms") govern your use of https://cibolo.nolisvite.com/, the Noli's Vite Cibolo customer portal, online forms, messages, notifications, and related website services. By using the site, you agree to these Terms. If you do not agree, do not use the site.

1. Website Information

We try to keep menu items, prices, hours, specials, events, images, descriptions, availability, and other information accurate. Information may change without notice, and errors may occur. The restaurant's current in-store information and direct confirmation control if website content conflicts with actual availability.

2. Reservations

• A reservation form submits your requested date, time, and party size. It does not guarantee a table until confirmed.
• We may contact you to suggest another time, request details, confirm, modify, or decline the request.
• Late-arrival, cancellation, deposit, large-party, or seating policies communicated during confirmation apply to the reservation.
• You are responsible for providing accurate contact details and updating or canceling a request when plans change.

3. Private Parties and Catering

Party and catering forms are inquiries only. Pricing, menus, capacity, deposits, minimums, staffing, delivery, setup, service charges, taxes, cancellation terms, and other event details are not binding until stated in a separate written confirmation, proposal, or agreement accepted by the parties.

4. Online Ordering and Payments

Online orders and payments may be processed by a third-party provider. Its terms, privacy policy, refund rules, availability, fees, and payment processing apply to transactions made through its service. Noli's Vite may still assist with restaurant-specific order issues, but the website does not guarantee third-party platform availability.

5. Menu, Allergies, and Dietary Information

• Menu ingredients, preparation methods, portions, prices, and availability may change.
• Tell restaurant staff about allergies or dietary needs before ordering. Website descriptions are not a guarantee that an item is free from an allergen or cross-contact.
• Images are illustrative and may not exactly match the item served.
• Alcohol is available only to eligible guests and may require valid identification. We may refuse alcohol service as required by law or safety policy.

6. Customer Accounts and Secure Links

Creating a customer account is optional. Accounts are available for guests who want a faster way to track and manage inquiries and submit new requests. You can always call or email us to make, change, or cancel a reservation or inquiry without an account.

• You must provide accurate information and keep your password, email account, devices, and secure View or Manage links protected. Portal profile details may be used to prefill reservation and inquiry forms while you are signed in.
• You may not access another person's inquiry, account, files, or messages.
• We may suspend or terminate access to protect customers, staff, the website, or restaurant operations.
• One-time or time-limited links may expire or become invalid after use.
• Customer edit requests are requests only. Changes are not effective until authorized staff approves them, and we may approve, reject, or ask for clarification.
• You are responsible for activity performed through your account unless you promptly report unauthorized access.

7. Messages, Files, and User Content

You retain ownership of content you submit. You give us permission to store, review, reproduce, transmit, and use it as reasonably necessary to respond to your request, operate the portal, evaluate an application, provide restaurant services, maintain records, and protect the site.

You may not upload or send content that is unlawful, harmful, threatening, abusive, deceptive, infringing, malicious, infected with code, unrelated to the request, or designed to bypass security. We may reject, quarantine, or delete unsafe content.

8. Job Applications

Submitting a job application does not guarantee review, interview, employment, compensation, or a response. Information must be truthful. Employment, if offered, is governed by separate documents and applicable law, not these website Terms.

9. Email and Text Message Terms

Transactional communications

By submitting a form or using an account, you authorize us to contact you about that request, including confirmations, questions, replies, status changes, edit-request approvals or rejections, security notices, and account actions.

Marketing email

Marketing emails will identify the sender and provide a way to unsubscribe. Unsubscribing from marketing does not stop necessary transactional messages about an active request or account.

Marketing text messages

• When you separately opt in, you agree to receive recurring marketing text messages from Noli's Vite about specials, events, and offers.
• Consent is not a condition of purchasing food, making a reservation, submitting an inquiry, or applying for a job.
• Message frequency varies. Message and data rates may apply.
• Reply STOP to cancel and HELP for help.
• Mobile carriers are not responsible for delayed or undelivered messages. Delivery is not guaranteed.
• You must be the account holder or have permission to use the mobile number you provide.

10. Promotions, Specials, and Events

Promotions may have dates, times, eligibility rules, exclusions, limits, or availability requirements. Unless stated otherwise, promotions cannot be combined, have no cash value, and may end or change where permitted by law. Event listings may be changed, postponed, or canceled.

11. Acceptable Use

You may not:

• attempt to bypass authentication, rate limits, file restrictions, or other security;
• use automated tools to submit spam, scrape private information, overload the site, or interfere with service;
• impersonate another person or submit false contact, reservation, event, or employment information;
• reverse engineer, exploit, or introduce malware into the website or portal; or
• use the site for unlawful, fraudulent, abusive, or infringing activity.

12. Intellectual Property

The site design, logos, branding, text, menus, photographs, graphics, software, and other content are owned by Noli's Vite or used with permission. You may view and print reasonable portions for personal, noncommercial use. No other license is granted.

13. Third-Party Services

Links or embedded content may lead to services operated by ordering providers, Google, social networks, calendar providers, media hosts, and others. We do not control those services and are not responsible for their content, availability, security, or policies. Your use of them is governed by their terms.

14. Disclaimer

To the maximum extent permitted by law, the website and portal are provided "as is" and "as available." We do not promise uninterrupted, error-free, or completely secure service. Nothing in these Terms limits rights that cannot legally be waived.

15. Limitation of Liability

To the maximum extent permitted by law, Noli's Vite will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from website use, inability to use the site, third-party services, lost messages, or unauthorized access. Any direct liability will be limited to the amount you paid directly to Noli's Vite for the specific transaction giving rise to the claim, unless applicable law requires otherwise.

16. Indemnity

To the extent permitted by law, you agree to reimburse Noli's Vite for reasonable losses, claims, and costs caused by your unlawful use of the site, violation of these Terms, infringement of another person's rights, or malicious content you submit.

17. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Claims may be brought in a court with proper jurisdiction in Texas unless applicable law requires another forum.

18. Changes and Severability

We may update these Terms by posting a revised version and changing the effective date. If any provision is unenforceable, the remaining provisions will continue to apply. Our failure to enforce a provision is not a waiver.
